March 19, 2025 Terms of service update

We are updating our terms of service on March 26, 2025, to add new language related to information we share with you, our renewal process, and our limitation of liability exceptions.

Communications

Section 3.3(b) contains the update:

Aha! and these third-party service providers shall … (b) only retain, use, or disclose Your Data or Personal Information for the specific purpose of providing the Service to You, including informing Subscribers of features and recommendations related to Aha!, the Services, and company and product building best practices;

Renewal

Section 7.1 contains the update:

7.1 Your Subscription Term will automatically renew for an additional Subscription Term consistent with your Service Plan unless you or Aha! provide no less than 30 days' notice to the other party in writing prior to the end of the then-current Subscription Term.

Limitation of liability

Section 9.3 contains the update:

9.3 The limitations in Section 9.1 and Section 9.2 shall not apply to (i) any intentional breach of confidentiality obligations set forth in Section 3, (ii) any breach of these Terms caused by either party’s willful, fraudulent, or unlawful misconduct, (iii) nor to indemnity obligations under Section 10.
